Accessing or using this website, constitutes acceptance of these Terms of Use (“terms”), as such may be revised by Underground Coffee Company (2014) limited from time to time, and is a binding agreement between the user (“you”) and Underground Coffee Company (2014) Limited governing the use of the website. If user does not agree to these terms, user should not access or use this website. These terms contain disclaimers and other provisions that limit our liability to user.
In the event there is any conflict or inconsistency between these Terms and any other terms of use that appear on the Sites, these Terms will govern. However, if you navigate away from the Sites to a third-party site, you may be subject to alternative terms and conditions of use, as may be specified on such site, which will govern your use of that site.
This website is operated by Underground Coffee Company (2014) Limited, New Zealand. When you buy something from our online store, you will be buying from Underground Coffee Roasters 190 Durham Street South, Christchurch Central, 8011, New Zealand.

Our website is intended for use in New Zealand and these terms are governed by New Zealand law, you agree that all disputes about these terms or your use of our website will be subject to the exclusive jurisdiction of the courts in that country. If you visit our website from another country, you agree that these terms are governed by New Zealand law, and any disputes about these terms or your use of our website will be subject to the exclusive jurisdiction of the courts of New Zealand.
How we work and when these terms apply
These terms apply when you visit our website or buy something from our webstore and explain what you should do if you have any questions. 1. Privacy
We seek to be as transparent as possible about how we use the information you supply to us. You can read about what personal data we collect and what we do with it by reading our Privacy Policy.
2. Ordering
To help make it simple to enjoy your favourite coffee we offer you the opportunity to create an account for any online purchases. You need to make sure your account information is accurate and keep it up to date, so we bill and ship to the right place. We will try to keep your account details safe and we ask you to do the same. You know what we mean – don’t let others use your account, do not share your username and password and protect your device appropriately.
If you place an order, we reserve the right at any time to decline the order, we will let you know why and seek to find the best alternate solution for you if this very rare circumstance occurs. We will refund all monies received in relation to a cancelled order.
We do our best to give accurate pictures and descriptions of products on our website, but remember that everyone’s screen is different, so items might look a bit different in real life, and colours might vary slightly from how they look on screen.
Our website is built using WordPress' platform with an integrated webstore using Woocommerce’s ecommerce plugin and Stripe Payments for secure payment processing, these platforms allow us to sell great coffee for you to sip, share and enjoy.
3. Payment and Security
We use Stripe for your payments. Stripe uses data encryption and real-time fraud prevention technology to keep your information secure, reducing the risk of online fraud. We pay a fee to the payment processor on each transaction, and rely on their expertise in secure payment processing, allowing us to stick to what we do best, delivering on the bold & punchy flavours in your coffee.

Payment of your order is always in New Zealand Dollars (NZD).
4. Office Accounts
We supply our freshly roasted coffee to offices nationwide.
Any business can qualify to be an office account providing they submit an application form and are approved by our internal teams. Office accounts do not have the right to on-sell our coffee, and must regularly purchase a one kilo minimum of coffee.
We have the right to cease your office wholesale supply if you do not consent to these terms.

6. Refund Policy
We want you to enjoy your coffee so if you have any concerns or things weren’t what you expected then please let us know. We don’t generally offer refunds for change of mind or because something isn’t to your taste, however if there is a quality issue we will make it right. We’ll always meet our legal obligations around refunds and returns.
All orders received are final and goods or service will be shipped as per the order form, so please make sure you double-check your address. If it’s too late though and you see a mistake, drop us a line and we will do our best to make the change for you. Alternatively, if you receive your order and something is amiss, contact our dispatch team through the details on the bottom of your order email. We will handle errors on a case-by-case basis.
We do ask that you raise any issues promptly with us. If you don’t do this, we might not be able to offer a refund, especially if the delay means we can’t verify the problem.
7. Ordering Online from the Rest of the World
Underground Coffee Roasters supplies coffee within New Zealand. If you live outside this region and would like to place an order please contact us on coffee@undergroundcoffee.co.nz in the first instance, and we will seek to find a solution that works for you.
Some orders might incur a customs or import duty, we are afraid to say we don’t have any control over these and don’t cover them in our shipping rate, these charges would be separate charges that you may need to meet. To ensure you have all your ducks in a row we encourage you to contact your local customs office.
8. Intellectual Property
Our website and all of the material on it is protected by copyright and other intellectual property rights (IP) that belong to Underground Coffee Roasters or our licensors. We ask you to respect these rights. Many of our friends and partners have agreed to be included within this website and to protect their rights and our own you must not copy, reverse engineer, adapt, modify, transmit, post or distribute, whether electronically or otherwise, any material from our website. While we are happy for you to peruse our website and use its public-facing functions, we don’t grant you any other licence or permission.
If you want to use some of the information we have please send us a written request and we will be in touch regards whether the use of our or others’ IP is permissible.
9. Browsing and using our website
When you visit our website please respect our ownership and control. Don’t do anything unlawful or offensive, track users or site activity, or try to get around our security.
Sometimes we link to or embed material in our website from a third party, like videos or links. We don’t control or endorse that third party material and you use it at your own risk.
10. Liability
We try to keep it running smoothly and accurately, but sometimes mistakes or other problems do happen. We’ll do our best to fix them, but (except for mandatory legal requirements that cannot be excluded) we don’t have any liability for errors, bugs or outages.
If you purchase something from our webstore, we will always honour our obligations to you under applicable consumer law, and any other legal rights that you have that cannot be legally excluded. However, any and all other liability that we have to you in connection with your purchase (or the product you purchased) will be capped at the amount you paid us for that purchase (including shipping). To the extent legally permissible, we will not be liable for any indirect, consequential or special losses, loss of profits, savings or revenue, lost data, lost use, replacement costs, or similar.
We are not responsible for a failure to perform an obligation set out in these terms, where the failure was caused by something beyond our reasonable control (like a natural disaster, a third party infrastructure or service provider failure, wars, strikes and so on).
